  2. EASEMENT AGREEMENT 
  3.  
  4. Barry Underwinter, referred to as OWNER, and Horst Grougham,
  5. referred to as GRANTEE,  agree: 
  6.  
  7. OWNER is the owner in fee simple of the following described real 
  8. estate: 
  9.  
  10. lot 23, Shady Acres Estates 
  11.  
  12. GRANTEE is the owner in fee simple of the following described 
  13. real estate: 
  14. lot 24, Shady Acres Estates 
  15.  
  16. In consideration of $ 25,000.00 ( twenty five thousand & no/100
  17. dollars) paid by GRANTEE, the  OWNER grants to GRANTEE the
  18. following easement: 
  19.  
  20. an easement and right of way for the purpose of building and
  21. maintaining a flood channel. In addition, the GRANTEE shall have
  22. the right of ingress and egress as necessary, and to enter and
  23. leave with such equipment and vehicles as may be necessary and
  24. useful for maintaining the flood channel. GRANTEE may use earth,
  25. gravel and sand found within the flood channel. 
  26.  
  27. The flood channel shall be located at: 
  28.  
  29. the first 5 feet within and along the western property line
  30.  
  31. Further, the OWNER agrees to the following restrictions on the 
  32. future use and enjoyment of OWNER's real property: 
  33.  
  34. no structures, vegetation or other objects will be allowed to 
  35. encroach within the easement stated above. 
  36.  
  37. The grant of easement herein shall bind the heirs and assigns of 
  38. the OWNER and GRANTEE. The rights herein shall be specifically 
  39. enforceable.
